Japanese Child Custody Laws

There are growing tensions between Japan and the rest of the world as child custody and abduction cases come tot eh foreground after recent legal cases in the news. At present, when a couple seperate in Japan, one parent is granted full custody of the child or children and the other parent has no access to their child until they reach adulthood. This has led many child experts and legal experts to call Japan to modify this custom as it will help children to develop properly, having communication with both parents.

Not only has the custody customs come under fire but there have also been cases of child abduction which is sanctioned by the Japanese government. If a Japanese woman marries a foreign husband and they have a child, when they seperate, the mother has the legal right to take their child back to Japan and prohibit the father from contacting the child. This is despite the custody laws in other countries, including the nationality of the husband.
